For the judiciary to function as an independent body, the separation of powers is a fundamental guarantee of its rights to do so. In the decision making process, the judges should have the freedom to decide cases with impartiality and the quest for justice, as their guiding principles, in accordance with their interpretation of law and the facts, deliberating without any restriction or external influence. The importance of an independent judiciary can best be summarised in the following points,-it is the duty of all governmental institutions and other establishments to recognize, respect and observe the independence of the judiciary.-impartiality, factual knowledge, accordance with the law of the land, should be the guiding principles-the judiciary will have jurisdiction over all matters of judicial import and have exclusive authority to implement its decision in accordance with the law-there should not be an untoward or inappropriate interference with the judicial deliberations, the decisions of the court will be open to judicial review
